CHAPTER 10, ARTICLE C, ANIMAL CONTROL,
OF THE CODE OF ORDINANCES OF THE TOWN OF DENTON

BE IT ORDAINED by the Board of Commissioners of the Town of Denton, North Carolina, that Chapter 10, Article C, Animal Control Ordinances of the Town of Denton is hereby amended by deleting and reserving Section 4 and by rewriting Section 3 in its entirety to read as follows:
PART 1:
“Section 3, Keeping and maintaining of fowl restricted.
It shall be unlawful for any person to keep any chickens, turkeys, ducks or other fowl in the town on any property less than two (2) acres in area, except within the Rural Agricultural (RA) district.
Any person who keeps or maintains any fowl within a qualified property shall keep or maintain such fowl within a fully enclosed pen or structure. Such pen or structure shall be at least fifty (50) feet away from any property line and will be within the rear yard as defined by the Denton Zoning Ordinance.
Any persons who keep or maintain such fowl within any prohibited zoning district, as of this date of this amendment, shall remove such fowl from the property by a date not later than thirty (30) days from the adoption of this amendment.
Any person violating this ordinance shall be subject to the penalties and remedies, either criminal or civil or both, as set forth in Section 10-99 of the Code of the Town of Denton.”
PART 2: This Ordinance shall become effective upon its adoption by the Board of Commissioners of the Town of Denton, North Carolina.
