AN ORDINANCE CREATING A MISDEMEANOR
FOR UNAUTHORIZED DUMPING ON TOWN OF DENTON PROPERTY

       WHEREAS, certain individuals have, without authorization, dumped trash and garbage on town property, including leaving the garbage and trash in the town’s garbage truck, in other trucks, and on town real property; and

       WHEREAS, the leaving of this property constitutes an unauthorized trespass on the property of the town; and

       WHEREAS, these actions cause the Town to incur costs and delay in servicing the citizens of the Town of Denton;

       IT IS THEREFORE ORDAINED AS FOLLOWS:

       It shall henceforward be a misdemeanor punishable by a fine in the maximum amount of $250.00 for any individual to, without authorization from an officer of the Town of Denton, deposit garbage or trash on the property of  the town, to include placement within any town vehicle.

       This ordinance shall be effective immediately.

Upon motion by Commissioner Stewart Sexton and a second by Commissioner J.T. Davis, this Ordinance passed by a vote of 5.
